1. Agreement Overview
This Service Agreement ("Agreement") is entered into between Name Century LLC, doing business as Automotive Repair Dealer ARD #315124 ("Provider," "we," "us"), and the customer ("Customer," "you") for automotive repair and maintenance services.
By purchasing a membership or requesting services, you agree to be bound by this Service Agreement and our Terms of Service.
2. Scope of Services
2.1 Oil Change Membership Services
The oil change membership includes:
- Mobile oil change service at customer's location
- Professional oil change performed by certified technicians
- Multi-point inspection (lights, wipers, fluid levels)
- Service every 3,000 miles during membership period
- Labor costs covered by membership fee
2.2 Not Included in Membership
The following are NOT included and will be charged separately:
- Engine oil (conventional, synthetic blend, or full synthetic)
- Oil filter
- Additional fluids (coolant, transmission fluid, etc.)
- Parts replacement (air filters, cabin filters, etc.)
- Additional services (tire rotation, brake inspection, etc.)
2.3 General Repair Services
We provide comprehensive automotive repair services including but not limited to:
- Engine diagnostics and repair
- Brake system service and repair
- Electrical system diagnostics
- Transmission service
- Suspension and steering repair
- Air conditioning service
- Preventive maintenance
3. Customer Responsibilities
3.1 Vehicle Access
For mobile services, customer must:
- Provide safe, level surface for vehicle service
- Ensure adequate workspace around vehicle
- Provide access to electrical outlet if needed
- Ensure no obstructions under vehicle
- Keep pets secured during service
3.2 Accurate Information
Customer agrees to:
- Provide accurate vehicle information (VIN, mileage, issues)
- Disclose known mechanical problems
- Report warning lights or unusual symptoms
- Update contact information promptly
3.3 Appointment Compliance
Customer agrees to:
- Be present during scheduled service time
- Provide notice of cancellation per policy
- Have vehicle accessible and available
- Remove personal valuables from vehicle
4. Service Standards
4.1 Quality Commitment
We commit to:
- Use qualified, trained technicians
- Follow manufacturer service specifications
- Use quality parts and materials
- Perform thorough inspections
- Maintain clean and professional service standards
4.2 Communication
We will:
- Confirm appointments 24 hours in advance
- Notify of any delays or changes
- Explain all recommended services
- Provide written estimates for repairs
- Obtain authorization before proceeding with additional work
5. Authorization and Approval
5.1 Service Authorization
No repair work exceeding $100 will be performed without customer authorization. Authorization may be obtained via:
- Electronic signature on service quote
- Verbal authorization (recorded)
- Written approval via email or text
5.2 Additional Work
If additional repairs are discovered during service:
- We will contact you immediately
- Provide revised estimate
- Await authorization before proceeding
- Document all communications
5.3 Emergency Repairs
For safety-critical issues (brake failure, steering problems), we may perform necessary repairs to make vehicle safe. Customer will be notified immediately.
6. Warranties
6.1 Workmanship Warranty
All repair work is warranted for:
- Duration: 90 days or 3,000 miles, whichever comes first
- Coverage: Defects in workmanship and labor
- Exclusions: Does not cover wear items, abuse, or accident damage
6.2 Parts Warranty
Replacement parts are warranted according to manufacturer specifications:
- Most parts: 12 months / 12,000 miles
- Premium parts: Per manufacturer warranty
- Used/rebuilt parts: 30 days or 3,000 miles
6.3 Warranty Claims
To file a warranty claim:
- Contact us within warranty period
- Bring vehicle for inspection
- Provide service receipt
- We will repair or replace at no charge if claim is valid
6.4 Warranty Exclusions
Warranty does not cover:
- Normal wear and tear
- Damage from accident or abuse
- Modifications by others
- Failure to follow maintenance recommendations
- Damage from external causes
7. Liability Limitations
7.1 Our Liability
Our liability is limited to:
- Cost of services performed
- Repair or replacement of damaged parts resulting from our negligence
- Direct damages only (no consequential damages)
7.2 Not Liable For
We are not liable for:
- Pre-existing damage not disclosed
- Hidden defects discovered during service
- Loss of use of vehicle
- Rental car costs
- Lost wages or business income
- Indirect or consequential damages
7.3 Property in Vehicles
We are not responsible for personal property left in vehicles. Remove all valuables before service.
8. Safety and Compliance
8.1 California Compliance
All services are performed in accordance with:
- California Bureau of Automotive Repair regulations
- Environmental Protection Agency standards
- OSHA safety requirements
- Manufacturer service specifications
8.2 Environmental Responsibility
We properly dispose of:
- Used motor oil
- Oil filters
- Automotive fluids
- Batteries and tires
9. Payment Terms
9.1 Payment Due
Payment is due upon completion of service unless prior payment arrangements have been made.
9.2 Estimates
Estimates are valid for 30 days and may change based on additional findings or parts availability.
9.3 Late Payments
Accounts more than 30 days overdue may incur:
- Late fee of $25 or 1.5% monthly interest
- Suspension of service
- Collection agency referral
10. Service Records
10.1 Record Keeping
We maintain detailed records of all services for minimum 7 years including:
- Service dates and mileage
- Work performed
- Parts installed
- Customer authorizations
10.2 Record Access
Customer may request copies of service records at any time at no charge.
11. Dispute Resolution
11.1 Informal Resolution
We encourage customers to contact us directly with concerns. Most issues can be resolved through discussion.
11.2 Mediation
If informal resolution fails, parties agree to attempt mediation before pursuing legal action.
11.3 Arbitration
Unresolved disputes shall be settled by binding arbitration in Orange County, California.
12. Agreement Modifications
We may modify this Service Agreement with 30 days notice to customers. Continued use of services constitutes acceptance of modifications.
13. Severability
If any provision is found unenforceable, remaining provisions remain in full effect.
